Supervisory oversight had also broken down: Anthony O’Connor, a self-employed contracts manager working for subcontractor T Vaughan Limited, had seen another worker in the same unsupported excavation earlier that day. Despite his industry experience and knowledge of standard excavation safety measures, O’Connor took no action to put proper safeguards in place.

The investigation led to a sentencing hearing at the Old Bailey on 9 September 2026. Principal contractor Appledorn Developments Limited and subcontractor T Vaughan Limited were convicted of breaching Section 3(1) of the Health and Safety at Work etc. Act 1974. T Vaughan Limited was fined £650,000 with £40,000 in costs, while Appledorn Developments Limited was fined £500,000. Individual accountability was also established after Anthony O’Connor pleaded guilty on 22 May 2026 to breaching Section 7 of the Act. O’Connor was sentenced to 10 months’ imprisonment, suspended for 18 months, and ordered to complete 150 hours of unpaid work in a prosecution brought by the Crown Prosecution Service.

Geotechnical Mechanics: Why No Ground Can Stand Unsupported

From a geotechnical standpoint, no ground profile can be trusted to remain stable unsupported under active site conditions.
